Using this Website

By using the Website, you agree to these Terms & Conditions. If you do not agree to them, please do not use the Website.

You may use the Website only for lawful purposes. You must not knowingly introduce malicious software, attempt to gain unauthorised access to the Website or its systems, interfere with its operation, or use Website content in a way that infringes our rights or anyone else’s rights.

Band information, music and third-party services

The Website provides information about Resonants, including music, releases, performances, news, merchandise and related activities.

We do not currently sell music directly through the Website. Links to streaming, download, ticketing, social-media or other third-party services are provided for convenience. If you buy or use anything through a third party, that transaction is between you and the relevant third party and is subject to its own terms and privacy information.

Intellectual property

Unless otherwise stated, the Website and its content — including the band name and branding, artwork, photographs, graphics, text, videos, recordings and other material — are owned by or licensed to us.

You may view and use Website content for your personal, non-commercial use. You must not reproduce, distribute, modify, publish, sell, license or otherwise commercially exploit our content without permission, except where the law allows it. Third-party trademarks and content remain the property of their respective owners.

Mailing list

You may choose to join our mailing list to receive news, release information, live-date announcements, merchandise updates and similar communications about the band.

Joining is optional. Where consent is required, we will ask you to make a clear choice to subscribe. You can unsubscribe at any time using the unsubscribe link in a marketing email or by contacting control.socials@resonantsband.com. Our Privacy Policy explains how we use personal information.

Website availability and accuracy

We take reasonable care over Website content but cannot promise that every item will always be complete, current or error-free. We may update, suspend or withdraw parts of the Website where reasonably necessary, including for maintenance, security or changes to the band’s activities.

Merchandise sales — when the online shop is enabled

Sections 6 to 15 apply only when merchandise can be ordered directly through the Website. They are intended for sales to consumers. The product page and checkout will provide the specific price, delivery options and other information applicable to an order.

Products

We will take reasonable care to describe merchandise accurately. Images are illustrative and colours or appearance may vary slightly because of screen settings and normal manufacturing or printing variation. All products are subject to availability.

Merchandise is expected to be produced and fulfilled by Printful. Print-on-demand production does not, by itself, remove a consumer’s statutory cancellation rights. The exception for made-to-order goods is relevant only where goods are made to the customer’s specifications or are clearly personalised.

Prices and payment

The total price payable to us will be shown before you place your order, together with any delivery charges payable to us. We are not currently VAT registered.

Payments will be processed by Paypal. Payment providers operate under their own terms and privacy information. We do not normally receive or store complete payment-card details ourselves.

Placing and accepting an order

Before placing an order, you will have an opportunity to check and correct the details you have entered. The checkout will make clear when clicking the final order button creates an obligation to pay.

Your order is an offer to buy the products shown in your order. We will normally send an email acknowledging receipt. A contract is formed when we send confirmation that the order has been accepted, or when the order is dispatched, whichever our checkout confirmation states.

We may refuse or cancel an order where reasonably necessary, for example if a product is unavailable, there is an obvious pricing or description error, payment is not authorised, we reasonably suspect fraud, or we cannot deliver to the address supplied. If we cancel after taking payment, we will refund the relevant amount.

Delivery and fulfilment

Available delivery destinations, charges and estimated delivery times will be shown at checkout. Unless a different period is agreed with you, goods will be delivered within the period required by applicable UK consumer law.

The products are made especially for customers as soon as an order is placed, which is why it takes a bit longer to deliver it to customers. Making products on demand instead of in bulk helps reduce overproduction.

US and other international import charges

Orders delivered outside the United Kingdom may be subject to customs duties, tariffs, import taxes, carrier charges or other fees imposed by the destination country or third parties.

Orders delivered in the continental US are printed in the US and not subject to tariffs.

Customers ordering internationally are responsible for checking local import rules and charges before ordering.

Your Right to Cancel an Online Merchandise Order

Our merchandise is produced to order by our third-party fulfilment partner, Printful.

Under UK consumer law, customers purchasing eligible merchandise online generally have the right to cancel their order without giving a reason within 14 days after the day on which they, or a person nominated by them (other than the carrier), receive the goods.

To exercise this right, you must notify us of your decision to cancel within the applicable 14-day period by emailing control.socials@resonantsband.com or by using the cancellation form provided at the end of these Terms & Conditions.

You must return the goods within 14 days of notifying us of your cancellation.

Exceptions

The statutory right to cancel does not apply to certain products, including goods made to your individual specifications or clearly personalised for you, where the relevant legal exception applies.

Standard band merchandise featuring our existing designs is not automatically excluded from cancellation rights simply because it is printed or manufactured after an order is placed.

Your statutory rights in relation to faulty, damaged or misdescribed goods remain unaffected.

Returns and Refunds After Cancellation

If you wish to return merchandise because you have changed your mind, please contact us at control.socials@resonantsband.com before sending any items back.

We will provide the appropriate return instructions and return address.

Please do not return products directly to Printful or to the address shown on the original shipping label unless we specifically instruct you to do so.

For eligible change-of-mind cancellations:

  • Merchandise must be returned within 14 days after you notify us of cancellation.
  • You are responsible for the direct cost of returning the merchandise, unless we agree otherwise. This will be made clear before you place your order.
  • You may inspect the merchandise as you reasonably would in a shop. Where handling beyond this is unnecessary and reduces its value, we may make a deduction from your refund where permitted by law.
  • We will refund the price paid for the cancelled merchandise and any applicable standard delivery charges, as required by law.
  • Where you selected a premium delivery service, we are not required to refund the additional amount above the cost of our least expensive standard delivery option.

Refunds will be made using the original payment method unless you expressly agree otherwise, and no refund fee will be charged.

We will issue refunds without undue delay and within 14 days of receiving the returned goods or receiving satisfactory evidence that they have been sent back, whichever is earlier. We may withhold the refund until either of these events occurs.

Faulty, Damaged, Misprinted or Incorrect Merchandise

We take care to ensure that merchandise is produced and supplied correctly. However, occasional production, printing or delivery errors may occur.

If an item arrives damaged, defective, misprinted, incorrectly supplied or not as described, please contact us at control.socials@resonantsband.com as soon as reasonably possible.

To help us investigate and resolve the problem promptly with our fulfilment partner, please provide:

  • Your order number.
  • A description of the problem.
  • Clear photographs of the affected merchandise, where reasonably possible.
  • Photographs of any damaged packaging, if relevant.

We encourage you to report any problems promptly, preferably within 14 days of receiving your order, so that we can raise the issue with our fulfillment partner without delay.

This suggested reporting period is not a deadline for exercising your statutory consumer rights.

Where merchandise is faulty, not of satisfactory quality, not fit for purpose or not as described, we will provide an appropriate remedy in accordance with UK consumer law.

Depending on the circumstances, your rights may include:

  • A full refund where you exercise a valid short-term right to reject faulty goods, normally within 30 days of receiving them.
  • A repair or replacement, where appropriate and required by law.
  • A price reduction or refund where a repair or replacement is unsuccessful, impossible or otherwise gives rise to that remedy under the law.

Where goods are faulty or incorrectly supplied, we will cover reasonable necessary return costs or provide an appropriate alternative arrangement.

Customers should contact us before sending faulty merchandise back, as photographic evidence may allow us to resolve some manufacturing problems without requiring a physical return.

Nothing in these Terms & Conditions excludes, restricts or otherwise affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

Address errors, non-delivery and refused parcels

You are responsible for providing a complete and accurate delivery address. If an order cannot be delivered because the address supplied was incorrect or incomplete, or because a parcel was not collected or was refused, we may charge reasonable additional delivery or return costs where the law allows. This does not affect your rights where the failure is ours or the carrier’s responsibility.

Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded or restricted.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for business losses suffered because you use the Website or buy goods wholly or mainly for business purposes, except where the law provides otherwise.

Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, but this does not remove any rights you have under consumer law. If such an event materially affects an order, we will take reasonable steps to minimise the impact and will tell you where appropriate.

Complaints and customer service

For Website or order enquiries, contact control.socials@resonantsband.com. We aim to respond within 3–5 working days.

Changes to these Terms

We may update these Terms when the Website, shop arrangements, suppliers or legal requirements change. The version published on the Website at the time you place an order will apply to that order, except where a change is required by law.

Governing law

These Terms are governed by the law of England and Wales. If you are a consumer, you may also have mandatory rights under the law applicable where you live. Nothing in these Terms removes those rights.
